We have been purchasing our cigarettes at a store called "THE CITY" ( TOBACCO & BEVERAGE CENTER) for well over 5 years, for the last 6 months this woman has been rude, telling my husband that if he takes a penny out of the " take a penny leave a penny dish, that he can't buy cigarettes, and just singiling him out. She's been making our cigarette run a complete nightmare. We have NEVER seen this woman before, we don't know her from a hole in the wall. So a couple weeks ago, we asked to talk to her boss and explained the situation, and he said " The way she is treating you is not appropriate, I will have a conversation with her". We haven't seen her since, so we thought everything was taken care of. We went in like an hour ago, and she went off on my husband and pretty much told him to get the F*** out of this store and that we're not allowed back. This has gone to far. I want to take legal action because the boss obviously doesn't care. Please help. We're in New Hampshire if that helps at all. Thank you.

My god lady, take your business elsewhere. Why are you voluntarily subjecting yourself and your husband to such treatment ?
You went up the chain of command and nothing changed. I suppose your business is not important to them.
Personally, this is a fight I would not bother with. Why on EARTH would you support a business that hires and keeps RAUNCHY employees? That makes no sense. If the cigs are cheaper there, then smoke a few less cigs a day and shop elsewhere, where you are welcomed. I'd never go back there, for absolute certainty!
Legal action requires damages and hurt feelings aren't damages. She's not the owner so she clearly can't ban you from the place. If you must persist on smoking yourselves to death just go back to the owner and tell that person what happened. Sounds like you're spending plenty of money at this establishment so perhaps they'll fire her.
You can file a report with law enforcement, but you CAN'T press charges.
In the case you describe, there is ABSOLUTELY NOTHING to charge the person with anyway.
In fact, if he is taking money from the dish and not USING it to make a purchase, your husband can be criminally charged with theft.
Your dilemma has already been solved. You're not allowed back in the store. Problem solved.
